Terms of Service
Effective April 27, 2026.
1. Acceptance of these terms
These Terms of Service ("Terms") form an agreement between you and Data Care Solutions LLC, the operator of RTCred ("RTCred", "we", "us"). RTCred is a product of Data Care Solutions LLC. By creating an account or using the service at rtcred.com or its subdomains (collectively, the "Service"), you agree to these Terms. If you do not agree, do not use the Service.
2. Who can use the Service
You must be at least 18 years old, capable of forming a legal contract in your jurisdiction, and (if using as a respiratory therapy professional or manager) practicing in good standing in your state. You agree to provide accurate account information and keep it current. You are responsible for activity under your account.
3. Accounts
- You sign in using a magic link sent to your email. Keep your email account secure — anyone who can read your email can sign into RTCred.
- One account per individual. Don't share credentials.
- Notify us at hello@rtcred.com if you suspect unauthorized access.
4. Therapists, departments, and data ownership
4.1 Therapist accounts
Therapist accounts are free, forever. The credentials you record, the documents you upload, and the CEUs you log are yours. If you leave a department, your data leaves with you — your previous manager loses access to your records the moment your association with that department ends.
4.2 Department accounts
Department accounts are paid (see Section 6). Managers and any designated assistant managers can see compliance metadata — credential type, expiration date, current/expiring/expired status — for therapists currently associated with the department. Managers cannot see the underlying documents (license photos, certificate PDFs) unless the therapist explicitly shares them, and access to all department data ends when an employment association is removed.
4.3 Joining and leaving a department
A therapist becomes associated with a department only by accepting an invitation, never automatically. Leaving requires a single click from the therapist's settings; managers cannot block a leave.
5. Acceptable use
You agree not to:
- Upload patient information, protected health information (PHI), or anything tied to a clinical encounter. RTCred is for staff credentials only.
- Upload content you don't have the right to upload.
- Misrepresent the authenticity of a credential, license, or certification.
- Attempt to access credentials, documents, or department data that don't belong to you.
- Probe, scan, or test the security of the Service except as part of an authorized disclosure program.
- Use the Service in any way that violates applicable law, including state respiratory care practice acts.
- Resell or sublicense the Service without our written permission.
- Send spam, phishing, or other abusive content through any RTCred-mediated channel.
We may suspend or terminate accounts that violate these rules, with notice when feasible.
6. Billing and subscriptions
6.1 Therapist plan
Free, forever. No credit card required.
6.2 Department plans
- Pricing: Per-seat monthly subscription, starting at $6 per therapist seat. The first ten founding departments receive 50% off for life on a flat-small plan. Current pricing is shown at sign-up.
- Seat counts: Billed monthly based on the number of active therapists associated with the department on the renewal date.
- Payment: Processed by Stripe. Card data is handled by Stripe directly; we never see or store full card numbers.
- Auto-renewal: Subscriptions renew automatically until canceled. Cancel any time from the department's billing settings.
- Failed payments: If a charge fails, we will retry and notify the manager. After 14 days of unresolved payment, the dashboard becomes read-only; therapist accounts remain unaffected and free.
6.3 60-day money-back guarantee
If RTCred isn't the right fit for your department, request a refund within 60 days of your first paid charge and we'll refund that charge in full, no questions asked. Email hello@rtcred.com. The guarantee covers your first paid period only.
6.4 Taxes
Prices are exclusive of taxes. Where required, we will collect applicable sales tax and remit it to the relevant authority.
7. Your content and your data
Anything you upload to the Service — credential records, documents, photos of cards, CEU certificates — remains yours. By uploading, you grant RTCred a limited license to store, process, transmit, and display that content solely for the purpose of operating the Service for you. We don't use it for anything else, and that license terminates when you delete the content or your account.
8. Reminders and communications
We send transactional emails (sign-in links, expiration reminders, security notices, billing receipts). These cannot be disabled while your account is active because they are part of the Service.
8.1 SMS program terms
By providing your phone number and opting into RTCred's text messaging program, you consent to receive recurring text messages from RTCred about credential expirations on your tracked credentials, sent by automated dialing systems where applicable. Consent to receive SMS is not a condition of using the Service.
- Program: RTCred credential expiration reminders.
- Frequency: Recurring messages — up to 4 per credential per renewal cycle (SMS at the 30-day and 7-day thresholds; email covers 90 / 60 / 30 / 7).
- Charges: Standard message and data rates may apply, depending on your wireless plan and carrier.
- Help: Reply HELP to any RTCred SMS for support, or contact hello@rtcred.com.
- Stop: Reply STOP (or END, CANCEL, UNSUBSCRIBE, QUIT) to any RTCred SMS. You will receive a one-time confirmation that you have been unsubscribed, and no further reminders will be sent.
- Carrier liability: Carriers are not liable for delayed or undelivered messages.
- No third-party sharing: Mobile information and messaging consent are not shared with third parties or affiliates for marketing or promotional purposes at any time.
Full SMS terms live in the Privacy Policy. You can withdraw SMS consent at any time without affecting your account; email reminders continue to work.
9. Disclaimers
RTCred provides software for tracking credentials. We do not provide legal, medical, regulatory, or compliance advice. The information you see in RTCred is informational only; you remain responsible for the actual currency of your credentials, your own compliance with state and federal practice acts, and your department's compliance with accreditation requirements (Joint Commission, DNV, CMS, state surveyors, and any others).
We do our best to deliver reminders on time, but we do not guarantee delivery. Email may be filtered as spam, SMS may be delayed by carriers, the Service may be temporarily unavailable. Treat reminders as a useful safety net, not a substitute for your own awareness of when your credentials expire.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM A COURSE OF DEALING OR USAGE OF TRADE.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RTCRED'S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS, WHICHEVER IS GREATER. RTCRED WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR REGULATORY FINES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, IN WHICH CASE THIS LIMITATION APPLIES TO THE MAXIMUM EXTENT PERMITTED.
11. Indemnification
You agree to indemnify and hold RTCred harmless from any claim, loss, or expense (including reasonable attorneys' fees) arising out of (a) your use of the Service in violation of these Terms, (b) your violation of applicable law, or (c) your violation of any third-party rights, including intellectual property and privacy rights.
12. Our intellectual property
The Service, including its code, design, copy, logos, and the rtcred.com domain, is owned by RTCred and protected by U.S. and international intellectual property law. Nothing in these Terms transfers ownership of the Service or any RTCred intellectual property to you.
13. Third-party services
The Service relies on third-party providers — including Supabase, Vercel, Resend, Twilio, Inngest, and Stripe — to function. Their availability, terms, and policies are outside our control. A list of subprocessors is in the Privacy Policy.
14. Termination
- You can close your account any time from Settings; your data is deleted within 30 days.
- We can suspend or terminate accounts that violate these Terms, with notice when feasible.
- Upon termination, your right to use the Service ends. Provisions that by their nature should survive (Sections 7, 9, 10, 11, 12, 15, 16) will survive.
15. Governing law and disputes
These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or the Service will be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to that jurisdiction. Each party waives any right to a jury trial.
16. Changes to these Terms
We may update these Terms. If changes are material, we'll notify you by email and post the updated Terms here at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
17. General
- Entire agreement. These Terms, the Privacy Policy, and any order forms or pricing pages you accept form the entire agreement between you and RTCred.
- Severability. If any provision is found unenforceable, the rest remains in effect.
- No waiver. Our failure to enforce any provision is not a waiver of that provision.
- Assignment. You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of substantially all assets.
- Force majeure. Neither party is liable for failures caused by events outside its reasonable control.
